Usually, a CTP claim can be settled when:

  • your injuries are medically stable, and
  • the long-term impact of your injuries is known.

If you're unsure about when or how your claim will settle, contact your CTP Insurer.

The CTP Insurer will make you an offer, which may include amounts for:

Paying your settlement

Before paying your settlement, the CTP Insurer may contact government authorities like Medicare and Centrelink, to tell them about the settlement.

If you received government benefits during your claim because of your injuries (for example, if some of your treatment was paid for by Medicare), the insurer may need to pay this back to the government authority. The insurer will then deduct that amount from your settlement.

If you owe money to the Australian Government, this can also be deducted from your settlement. The insurer will tell you if this is going to happen.

Filing a court action

If your claim cannot be resolved within three years of the motor vehicle accident, you need to file a court action*.

As this deadline approaches, your insurer will contact you to explain what is required. You do not need a lawyer, but you can seek legal advice.

*Unless you were under 18 when the accident happened. If you were under 18, you need to file a court acton within three years of your 18th birthday, if the claim is not yet resolved.

Court approval

A claim settlement needs to be approved by the Court if the claimant:

  • Is under 18
  • Cannot give sufficient instructions because of a mental or physical disability or illness.

If this is the case, the CTP Insurer will notify the claimant's guardian and provide information about how to do this.

Legal or court fees for getting court approval can be recovered from the insurer.
